A Delta High Court sitting in Effurun has granted approval for an out-of-court settlement between Brownhill Investment Company and David Adeleke, popularly known as Davido.
Justice Michael Obi of High Court Three in Effurun commended both parties on Thursday for their commendable decision to resolve the matter amicably through an out-of-court settlement.
“I commend both parties for exploring an amicable resolution to settle out of court,” Obi said.
According to a report by the News Agency of Nigeria (NAN), Brownhill Investment Company, owned by Amaju Pinnick, the former President of the Nigeria Football Federation (NFF), initiated a legal action marked EHC/183/2023 against afrobeat singer Davido and his music label, Davido Music Worldwide Limited, as joint defendants in October 2023. This legal action was in response to an alleged breach of contract related to their failure to perform at the 19th edition of the ‘Warri Again Concert’.
In the lawsuit, Brownhill Investment Company sought ₦2 billion as general damages from the defendants for their alleged failure to fulfill the contract for the concert. Additionally, Pinnick’s company requested ₦150 million for legal and professional fees, as well as ₦30 million for filing costs.
After the court’s decision, counsel to the defendants, Oladayo Ogungbe, informed NAN that both parties had successfully pursued an out-of-court settlement during the court proceedings.
“Davido is coming again to Warri on October 4 to perform – that forms part of the settlement.
“It’s fine. It is better than going through the rigours of litigations.
“Both parties consider the option of having the matter settled out of court, which in my opinion as a lawyer, is the best approach to any litigation.
“It is a win-win situation to both parties,” Ogungbe added.
NAN reports that the ‘Warri Again” concert is an annual event organised by Pinnick to celebrate entertainers from the Niger Delta region.
